1. Parties
This Agreement is between THE COLLECTORS LAB LTD (Company No. 16947052), 61A Chase Court Gardens, Enfield, England EN2 8DJ (we/us), and the person named in section 1 above (you).
2. Consigned items
You confirm you own the items in Schedule A and authorise us to act for you when marketing and selling them through our website, events and social media. We may accept any sale at or above the agreed minimum price, take payment and arrange delivery. You own an item until it is sold. We may refuse or return an item if we have reasonable concerns about its authenticity, ownership, condition or saleability. You also allow us to photograph and film the items to help sell them.
3. Consignment period
The initial consignment period is 90 days from the date we confirm receipt. You agree to leave items with us during that period unless we agree otherwise. Once we accept a buyer's order, the sale is binding and the item cannot be withdrawn. If an item remains unsold, we can agree to extend the period, change the minimum sale price or return it.
4. Minimum sale price
We agree a minimum sale price for each item and will not sell below it without your written approval. This is the buyer's item price before our commission is deducted and excludes delivery.
5. Commission
Commission is based on the final item sale price, excluding delivery. The rates below are the total commission charged, including VAT where applicable:
- £250 to £499.99: 15% (items sent to us from within the UK only)
- £500 to £1,999.99: 12.5%
- £2,000 and above: 10%
Items below £250, and international consignments below £500, are accepted only if agreed in writing.
6. Payment
We pay you by UK bank transfer within 14 business days after delivery, cleared buyer payment and the end of any applicable buyer cancellation period, provided there is no open return, chargeback or fraud check. We deduct our commission and any amount you owe us. If we later have to refund a buyer or meet a chargeback because of an item's authenticity, ownership, condition, description or information you gave us, you must repay that amount and our reasonable direct costs.
7. Shipping
You are responsible for tracked delivery to us and should insure valuable items. Risk stays with you until we confirm receipt. We do not cover shipping, customs duties, import VAT, taxes, brokerage, handling or other import charges. If we pay any of these, we may deduct them from your payout. Buyers pay delivery unless stated otherwise. You pay return shipping on unsold items unless we agree otherwise.
8. Authenticity
You confirm each item is authentic, legally owned, accurately described and lawful to sell. Tell us about any known damage, alteration, restoration, tampering or other issue that could affect authenticity or value. We may ask for ID or proof of ownership before accepting an item or paying you. If an item is counterfeit, stolen or materially misrepresented, you must cover any resulting buyer refund, chargeback, authentication or shipping cost and other reasonable direct loss.
9. Returns
We do not offer discretionary returns. Buyer returns are accepted only where required by law or agreed by us. If an item is returned in materially the same condition, it goes back into consignment unless you ask us to return it to you.
10. Care of items
We take reasonable care of items while they are with us. We do not hold specialist insurance for consigned property, so please check your own cover applies while items are in transit and with us. We are responsible for direct loss or damage caused by our negligence, but not normal changes in market value.
11. Privacy
We use your information to manage consignments, make payments, prevent fraud and meet legal obligations. Our Privacy Policy at thecollectorslab.co.uk explains this in more detail.
12. Starting the service & cancellation
If you're consigning personally and sign online or away from our premises, you normally have 14 days from the day after this agreement is made to cancel without giving a reason. To cancel, email info@thecollectorslab.co.uk or use the cancellation form. If you want us to start during those 14 days, tick the box in section 4. You can still cancel during the 14-day period and we will not charge you for work already carried out. Once the service is fully completed after you asked us to start, your 14-day cancellation right ends. If you do not tick the box, we'll wait 14 days before starting.
13. General
This Agreement is governed by the laws of England and Wales. Changes must be agreed in writing, including by email or message. If any part cannot be enforced, the rest still applies. Nothing here affects legal rights that cannot be excluded or limited.
